Terms and Conditions

Introduction

• These terms and conditions ("Terms") govern the provision of newborn and maternity photography services ("Services") by NINI Images.

• By booking our Services, you ("Client") agree to be bound by these Terms.

Booking and Payment

• Bookings are subject to availability and are confirmed upon receipt of a non-refundable booking fee of $100.

• The remaining balance is due on the day of the photoshoot.
   

WHAT IF I NEED TO RESCHEDULE OR CANCEL MY BOOKING?

• Cancellations made less than 24HRS prior to the scheduled photoshoot will result in forfeiture of the booking fee.

• The Client may reschedule the photoshoot once, subject to availability, at no additional charge, provided notice is given at least 24 HRS prior to the original appointment.

Your Session

• We maintain complete creative authority over the styling of the session, as the aesthetic presentation is integral to NINI IMAGES.The Photographer will make every effort to capture high-quality images, but cannot guarantee specific results.

• The Client is responsible for ensuring the cooperation of all participants, including newborns and children, during the photoshoot.
   

Post-production and delivery

• We maintain exclusive creative control over selecting and providing images from your session. Unedited RAW files are not shared, sold, or released.

• Edited images will be delivered to the Client via private domain within 2-4 weeks following the photoshoot.

• The Client understands and agrees that the Photographer retains copyright ownership of all images.

Copyright and Advertising Rights​

• Nitish Gurung of NINI Images holds copyright for all images. Altering images breaches copyright law. Images may be used for NINI Images advertising/portfolio, but if you prefer not to, the model release can be adjusted. 

• The Client is granted personal, non-commercial usage rights to the images for sharing on social media and personal printing.

• Commercial use of images requires prior written consent from the Photographer.

Privacy

• The Photographer will handle personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth).

• The Client's personal information will only be used for the purpose of providing the Services and will not be shared with third parties without consent.

Limitation of Liability

• To the extent permitted by law, the Photographer shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the Services.

• The Photographer's liability for any breach of these Terms shall be limited to the amount paid by the Client for the Services.

Governing Law

• These Terms shall be governed by and construed in accordance with the laws of Australia.

• Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of ACT

By booking our Services, the Client acknowledges that they have read, understood, and agree to abide by these Terms and Conditions.
